Pride and Prejudice: Elizabeth and Darcy Essay

In Pride and Prejudice, Darcy and Elizabeth first encounter at the ball in Meryton. Not such of a good impression they had on each other. Darcy’s first opinion is well understood as he says, â€Å"She is tolerable; but not handsome enough to tempt me.†(Page 8) As Elizabeth overhears his critical comment, she dislikes Darcy in that very moment for being so proud and full of himself. As Darcy is being convinced to dance with Elizabeth he accepts while she refuses. That is when Darcy gets his first insight of Elizabeth’s attitude. It came shocking to Darcy that Elizabeth refuses to dance with him; a fine young man who has such fortune and reputation. Through conversation with Elizabeth, Darcy notices she is not like other women. At the time women settled for what was given to them for beneficial pretenses such as marrying a man of good reputation with a fortune. Eliza does not give herself out to Darcy, instead she speaks her mind not giving much importance to the disagreements others including Darcy, will have on her comments or opinions. Darcy likes that she is not like other women, so in need of a husband. Unknowingly Darcy is being drawn in by her inner and outer beauty. Darcy is a clever, proud, and demanding man as Elizabeth describes him. (Page 33) He considers himself superior to others who according to him were not brought up well and have such low connections. It comes naturally for Elizabeth to laugh at Mr. Darcy for being so bitter and dull. Little by little he begins to show his emotions for Eliza as he becomes weak against her. Miss Bingley is one of the first to ever notice this weakness he has for her and tries to feed to his negative opinions of her and her family only letting him reveal that he had never met such a beautiful acquaintance as Eliza. So it was, Darcy had completely fallen in love with Elizabeth and reveals his emotions to her thus at the same time insulting her and her family for being of such low class in comparison to him. Elizabeth becomes very insulted and refuses his proposal of marriage. Eliza says to Darcy, â€Å"Why  with so evident a design of offending and insulting me you chose to tell me you liked me against your will, against your reason, and even against your character?† (Page 163) From this moment on, Eliza began to fall in love with Darcy as well. It is evident that they are both completely in love with each other. Their relationship is most convenient to the Bennets while they have a daughter who will marry a man of great fortune that will as a result make them look good to society. Most importantly, Eliza is going to marry out of love rather than to settle for less as Charlotte did by marrying Mr. Collins whom she did not love but instead married for her own convenience. As for Darcy, not everyone is in such agreement that he marries such a woman as Eliza but yet their marriage is most likely to succeed knowing that the most important factor, love, is in place. At the end, Lady de Bourgh has no choice but to be in agreement of their marriage.

Lars Von Trier Essay

Lars Trier was born in Kongens Lyngby, north of Copenhagen, the son of Inger Trier (nà ©e Hà ¸st, 1915—1989). He had believed that his biological father was Ulf Trier (1907—1978), until his mother revealed to him on her deathbed that he had been conceived as a result of an affair she had with her employer, Fritz Michael Hartmann. His mother considered herself a Communist, while his father was a Social Democrat, and both were committed nudists,[5] and the young Lars went on several childhood holidays to nudist camps. They regarded the disciplining of children as reactionary. Trier has noted that he was brought up in an atheist family, and that although Ulf Trier was Jewish, he was not religious. His parents did not allow much room in their household for â€Å"feelings, religion, or enjoyment†, and also refused to make any rules for their children,[6] with complex results for von Trier’s personality and development.[7] He began making his own films at the age of 11 after receiving a Super-8 camera as a gift and continued to be involved in independent moviemaking throughout his high school years.[3] In 1979, he was enrolled in the National Film School of Denmark.[8] His peers at the film school nicknamed him â€Å"von Trier†. The name is sort of an inside-joke with the von (German â€Å"of† or â€Å"from† used as a nobiliary particle), suggesting nobility and a certain arrogance, while Lars is a very common and Trier not an unusual name in Denmark.[9] He reportedly kept the â€Å"von† name in homage to Erich von Stroheim and Josef von Sternberg, both of whom also added it later in life.[10] During his time as a student at the school he made the films Nocturne and The Last Detail, both of which won Best Film awards at the Munich International Festival of Film Schools.[11][12] In 1983 he graduated with the 57-minute Images of Liberation, which became the first Danish school film to receive a regular theatrical release.[13] Europe trilogy After graduation he began work on the very stylized crime drama, The Element of Crime (Forbrydelsens element 1984), which won a technical award at the Cannes Film Festival. His next film was Epidemic (1987), which was also shown at Cannes in the Un Certain Regard section. The film is partly a dark science fiction-tale of a future plague epidemic, and partly chronicles two filmmakers (played by Lars von Trier and screenwriter Niels Và ¸rsel) preparing that film, with the two storylines ultimately colliding. For television von Trier directed Medea (1988), which won the Jean d’Arcy prize in France. It was based on a screenplay by Carl Th. Dreyer and starred Udo Kier. He completed the Europe-trilogy in 1991 with Europa (released as Zentropa in the U.S.), which won the Prix du Jury at the 1991 Cannes Film Festival[14] and picked up awards at other major festivals. In 1990 he also directed the music video for the worldwide hit â€Å"Bakerman† by Laid Back.[15] This video was reused in 2006 by the English DJ and artist Shaun Baker who did a remake of Bakerman. Zentropa and The Kingdom In 1992 he and producer Peter Aalbà ¦k Jensen founded the movie production company Zentropa Entertainment, named after a train company in Europa, their most recent film at the time.[8] The reason for doing this was to achieve financial independence and to have total creative control. The production company has produced many movies other than von Trier’s own as well as television series. It also has produced hardcore sex films: Constance (1998), Pink Prison (1999), HotMen CoolBoyz (2000) and All About Anna (2005). In order to make money for his newly founded company,[16] he made The Kingdom (Riget, 1994) and The Kingdom II (Riget II, 1997), a pair of miniseries recorded in the Danish national hospital, the name â€Å"Riget† being a colloquial name for the hospital known as Rigshospitalet (lit. The Kingdom’s Hospital) in Danish. A projected third installment in the series was derailed by the 1998 death of Ernst-Hugo Jà ¤regà ¥rd, who played Helmer, one of the ma jor characters. Dogme 95 In 1995, Lars von Trier and Thomas Vinterberg presented their manifesto for a new cinematic movement which they called Dogme 95. It would however take a while before the first of these films appeared, and at this point many thought of the concept mainly as a radical idea with no future.[citation needed] In 1996, von Trier conducted an unusual theatrical experiment in Copenhagen involving 53 actors, which he titled Psychomobile 1: The World Clock. A documentary chronicling the project was directed by Jesper Jargil, and was released in 2000 with the title De Udstillede (The Exhibited). Von Trier’s next film, Breaking the Waves (1996), the first film in von Trier’s ‘Golden Heart Trilogy’, won the Grand Prix at Cannes and featured Emily Watson, who was nominated for the Academy Award for Best Actress. Its grainy images and hand-held photography pointed towards Dogme 95. The second was The Idiots (1998), nominated for a Palme d’Or, which he presented in person at the Cannes Film Festival notwithstanding his dislike of travelling. Dancer in the Dark (2000) was the final component of the trilogy. As originator of the Dogme 95 concept, which has led to international interest in Danish film as a whole, he has inspired filmmakers all over the world.[17] Trier and Thomas Vinterberg, who created the Dogme 95 Manifesto and the â€Å"Vow of Chastity† together with their fellow Dogme directors Kristian Levring and Sà ¸ren Kragh-Jacobsen shared in 2008 the European Film Award European Achievement in World Cinema. Explicit images Von Trier’s use of sexually explicit images in The Idiots (1998) started a wave[citation needed] of arthouse mainstream films with unsimulated sex, such as Catherine Breillat’s Romance (1999), Baise-Moi (2000), Intimacy (2001), Vincent Gallo’s The Brown Bunny (2003) and Michael Winterbottom’s 9 Songs (2004). In 1998, Lars von Trier also made history by having his company Zentropa be the world’s first mainstream film company to produce hardcore pornographic films. Three of these films, Constance (1998), Pink Prison (1999) and the adult/mainstream crossover-feature All About Anna (2005), were made primarily for a female audience, and were extremely successful in Europe, with the first two being directly responsible for the March 2006 legalizing of pornography in Norway.[18] Women too like to see other people having sex. What they don’t like is the endless close-ups of hammering bodyparts without a story. Lars von Trier is the first to have realised this and produced valuable quality porn films for women. — Stern No. 40, 27 September 2007[19] Lars von Trier’s initiative spearheaded a European wave of female-friendly porn films from directors such as Anna Span, Erika Lust and Petra Joy, while von Trier’s company Zentropa was forced to abandon the experiment due to pressure from English business partners.[20] In July 2009, women’s magazine Cosmopolitan ranked Pink Prison as No. 1 in its Top Five of the best women’s porn, calling it the â€Å"role model for the new porn-generation†.[21] Lars von Trier would return to explicit images in his self-directed Antichrist (2009), exploring darker themes. 2000s In 2000, von Trier premiered a musical featuring Icelandic musician Bjà ¶rk, Dancer in the Dark. The film won the Palme d’Or at Cannes.[22] The song â€Å"I’ve Seen It All† (which Trier co-wrote) received an Academy Award nomination for Best Song. The Five Obstructions (2003), made by Lars von Trier and Jà ¸rgen Leth, is a documentary, but also incorporates lengthy sections of experimental films. The premise is that Lars von Trier challenges director Jà ¸rgen Leth, his friend and mentor, to remake his old experimental film The Perfect Human (1967) five times, each time with a different ‘obstruction’ (or obstacle) specified by von Trier.[23] He then directed two films in his announced ‘U.S. trilogy’: Dogville (2003), starring Nicole Kidman and Manderlay (2005), starring Bryce Dallas Howard in the same role – as Grace. Both films are extremely stylized, with the actors playing their parts on a nearly empty soundstage with little but chalk marks on the floor to indicate the sets. Both films had huge casts of major international actors (Harriet Andersson, Lauren Bacall, James Caan, Danny Glover, Willem Dafoe, etc.), and questioned various issues relating to American society, such as intolerance in Dogville and slavery in Manderlay. Controversy erupted on the 2004 set for Manderlay when actor John C. Reilly walked off the Trollhà ¤ttan, Sweden, set in late March. Reilly walked off the film when he learned that an upcoming scene involved the slaughter of a donkey for food. The film’s producer says the animal—who was old and not expected to live much longer—was killed off-camera by a certified veterinarian, in accordance with Swedish law. Reilly was replaced by Zeljko Ivanek.[24] The U.S. was also the scene for Dear Wendy (2005), a feature film directed by von Trier’s â€Å"Dogme-brother† Thomas Vinterberg from a script by von Trier. It starred Jamie Bell and Bill Pullman and dealt with gun worship and violence in American soci ety. In 2006, von Trier released a Danish-language comedy film, The Boss of it All. It was shot using a process that von Trier has called Automavision, which involves the director choosing the best possible fixed camera position and then allowing a computer to randomly choose when to tilt, pan or zoom. It was followed by an autobiographical film, De unge à ¥r: Erik Nietzsche sagaen del 1 (2007), scripted by von Trier but directed by Jacob Thuesen, which tells the story of von Trier’s years as a student at the National Film School of Denmark. It stars Jonatan Spang as von Trier’s alter ego, called â€Å"Erik Nietzsche†, and is narrated by von Trier himself. All main characters in the film are based on real people from the Danish film industry,[citation needed] with the thinly veiled portrayals including Jens Albinus as director Nils Malmros, Dejan ÄÅ'ukić as screenwriter Mogens Rukov and Sà ¸ren Pilmark in an especially unflattering portrayal as sex-obsessed sch ool principal Henning Camre. Von Trier’s next feature film was Antichrist, an art film about â€Å"a grieving couple who retreat to their cabin in the woods, hoping a return to Eden will repair their broken hearts and troubled marriage; but nature takes its course and things go from bad to worse†. The film, which includes sexually explicit content, stars Willem Dafoe and Charlotte Gainsbourg. It premiered in competition at the 2009 Cannes Film Festival, where the festival’s jury honoured the movie by giving the Best Actress award to Gainsbourg.[25] The Cannes Film Festival Ecumenical Jury, which gives prizes for movies that promote spiritual, humanist and universal values, also â€Å"honoured† the film with a special â€Å"anti-award†; a spokesman for the jury described it as â€Å"the most misogynist movie from the self-proclaimed biggest director in the world.†[26] In 2010 the Swedish newspaper Dagens Nyheter reported on their website that the film production company Zentropa is reportedly making more revenue from suing movie pirates in Germany that have downloaded Antichrist illegally than from box office and DVD sales, demanding a payment of around 1,300 euros per download to avoid legal action.[27] 2010s Von Trier’s latest work is Melancholia, a psychological disaster drama;[28] shot between 22 July and 8 September 2010 at Film i Và ¤st’s studios in Trollhà ¤ttan, Sweden,[29] and with exteriors in the area surrounding the Tjolà ¶holm Castle.[30] Magnolia Pictures has acquired the distribution rights for North America.[31] The film was in competition at the 2011 Cannes Film Festival.[32] Von Trier announced that after finishing Melancholia he hopes to begin production of The Nymphomaniac, a two-part film about the sexual awakening of a woman (Charlotte Gainsbourg).[33] The director explained how he got the idea for the upcoming project: â€Å"my DP on [Melancholia], Manuel Claro, at one point voiced a surprising prejudice. He urged me not to fall into the trap that so many aging directors fall into – that the women get younger and younger and nuder and nuder. That’s all I needed to hear. I most definitely intend for the women in my films to get younger and younger and nuder and nuder†.[34] The announced cast includes Gainsbourg, Stellan Skarsgà ¥rd, Shia LaBeouf, Willem Dafoe, Connie Nielsen, Jamie Bell, Jens Albinus, Jesper Christensen and Nicole Kidman. Phobias Von Trier suffers from multiple phobias, including an intense fear of flying.[35] His fear of air travel frequently places severely limiting constraints on him and his crew, necessitating that virtually all of his films be shot in either Denmark or Sweden, even those set in the United States or other foreign countries. Von Trier has had a number of his films featured at the Cannes Film Festival over the course of his career, and each time has insisted on driving from Denmark to France for the festival and back. On numerous occasions von Trier has also stated that he suffers from occasional depression which renders him incapable of performing his work and unable to fulfill social obligations.[36] Filming techniques Lars von Trier has said that â€Å"a film should be like a stone in your shoe†. In order to create original art he feels that filmmakers must distinguish themselves stylistically from other films, often by placing restrictions on the filmmaking process. The most famous restriction is the cinematic â€Å"vow of chastity† of the Dogme95 movement with which he is associated, though only one of his films, The Idiots, is an actual Dogme 95 film. In Dancer in the Dark, jump shots[37] and dramatically-different color palettes and camera techniques were used for the â€Å"real world† and musical portions of the film, and in Dogville everything was filmed on a sound stage with no set where the walls of the buildings in the fictional town were marked as lines on the floor. Von Trier often shoots digitally and operates the camera himself, preferring to continuously shoot the actors in-character without stopping between takes. In Dogville he let actors stay in character for hours, in the style of method acting. These techniques often put great strain on actors, most famously with Bjà ¶rk during the filming of Dancer in the Dark. Often he uses the same regular group of actors in many of his films: some of his frequently used actors are Jean-Marc Barr, Udo Kier and Stellan Skarsgà ¥rd. He is heavily influenced by the work of Carl Theodor Dreyer[38] and the film The Night Porter.[39] He was so inspired by the short film The Perfect Human directed by Jà ¸rgen Leth that he challenged Leth to redo the short five times in feature film The Five Obstructions.[40] Trilogies Von Trier has on occasion referred to his films as falling into thematic and stylistic trilogies. This pattern began with his first feature film, marking the beginning of The Europa Trilogy, though he claims a trilogy was not initially planned, instead being applied to the films in retrospect. The Europe trilogy illuminated the traumas of Europe in the past and future. This trilogy includes The Element of Crime (1984), Epidemic (1987) and Europa (1991). The Golden Heart trilogy was about naive heroines who maintain their ‘golden hearts’ despite the tragedies they experience. This trilogy consists of Breaking the Waves (1996), The Idiots (1998) and Dancer in the Dark (2000). While all three films are sometimes associated with the Dogme 95 movement, only The Idiots is a certified Dogme 95 film. The USA: Land of Opportunities trilogy follows the character of Grace, and is set in a stylized American past. Von Trier has stated he was inspired to make a trilogy about the United States as a reaction to Americans at the Cannes film festival who said he had no right to make the Dancer in the Dark,[8] which was often viewed as being critical of a country he has never been to (and has no intention of ever visiting, due to his phobia of travel); however, von Trier himself has stated in interviews he did not intend it to be a criticism of America, saying the film takes place in a â€Å"fictional America†. Von Trier proposed the films as ‘a series of sermons on America’s sins and hypocrisy’[citation needed], inspired by the fact that American movie makers have made many movies about places across the world to which they have not travelled. All three movies will be shot in the same distinctive style, on a bare sound stage with no set and buildings marked by lines on the floor. This style is inspired by 1970s televised theatre. The trilogy will consist of Dogville (2003), Manderlay (2005) and the so far not produced Washington. The Depression Trilogy consists of Antichrist, Melancholia and the yet to be completed, Nymphomaniac. All three star Charlotte Gainsbourg and deal with characters that deal with depression or grief in different ways. This trilogy is said to represent the current depression that von Trier himself is currently going through. The Kingdom (Riget) was planned as a trilogy of three seasons with 13 episodes in total, but the third season was not filmed due to death of star Ernst-Hugo Jà ¤regà ¥rd shortly after completion of the second season. Biological father In 1989, von Trier’s mother revealed on her deathbed that the man who he thought was his father was not, and that she had had a tryst with her former employer, Fritz Michael Hartmann (1909–2000),[41] who descended from a long line of Roman Catholic classical musicians (his grandfather was Emil Hartmann, his great grandfather J.P.E. Hartmann, his uncles included Niels Gade and Johan Ernst Hartmann and thus Niels Viggo Bentzon was his cousin). She stated that she did this in order to give her son â€Å"artistic genes†.[42] Until that point I thought I had a Jewish background. But I’m really more of a Nazi. I believe that my biological father’s German family went back two further generations. Before she died, my mother told me to be happy that I was the son of this other man. She said my foster father had had no goals and no strength. But he was a loving man. And I was very sad about this revelation. And you then feel manipulated when you really do tur n out to be creative. If I’d known that my mother had this plan, I would have become something else. I would have shown her. The slut![43] During the German occupation of Denmark, Fritz Michael Hartmann worked as a civil servant and joined a resistance group (Frit Danmark), actively counteracting any pro-German and pro-Nazi colleagues in his department.[44] Another member of this infiltrative resistance group was Hartmann’s colleague Viggo Kampmann, who would later become prime minister of Denmark.[45] After four awkward meetings with his biological father, the man refused further contact.[46] The revelations led von Trier to attempt to â€Å"erase† the connections with his stepfather by converting to Catholicism, and to rework his filmmaking into a style emphasizing â€Å"honesty†.[3] I don’t know if I’m all that Catholic really. I’m probably not. Denmark is a very Protestant country. Perhaps I only turned Catholic to piss off a few of my countrymen.[43] In 2009, he declared, â€Å"I’m a very bad Catholic. In fact I’m becoming more and more of an atheist.†[47] Controversy at 2011 Cannes Film Festival On 19 May 2011, Cannes Film Festival’s board of directors declared von Trier persona non grata for comments he made during a press conference for his film Melancholia the day before, an unprecedented move for the film festival.[48][49] Responding to a question by The Times film critic Kate Muir about his German roots and his comments in a Danish film magazine about the Nazi aesthetic, von Trier claimed to have some sympathy for and understanding of Adolf Hitler,[50] and then jokingly claimed to be a Nazi himself:[51][52] Von Trier at the 2011 Cannes Film Festival. What can I say? I understand Hitler, but I think he did some wrong things, yes, absolutely. †¦ He’s not what you would call a good guy, but I understand much about him, and I sympathize with him a little bit. But come on, I’m not for the Second World War, and I’m not against Jews. †¦ I am of course very much for Jews, no not too much, because Israel is pain in the ass, but still how can I get out of this sentence. †¦ — Press Conference for Melancholia, Cannes, 2011[53][54] Referring to the art of Nazi architect Albert Speer, von Trier added: †¦ he had some talent that was kind of possible for him to use during†¦ Ok, I’m a Nazi. Then, to Toronto Star film critic Peter Howell, who questioned whether Melancholia could be an answer to Hollywood blockbusters and asked von Trier if he could â€Å"envision doing a film on a grander scale than this†, von Trier replied: On a grander scale? Yeah. Yeah that’s what we Nazis, we have a tendency to do things on a greater scale. Yeah, maybe you could persuade me into the final solution with journalists. †¦ Hours later, von Trier released a brief statement of apology about his comments at the press conference: â€Å"If I have hurt someone this morning by the words I said at the press conference, I sincerely apologise. I am not anti-semitic or racially prejudiced in any way, nor am I a Nazi.†[55] The next day, the festival directors held an extraordinary meeting, deciding his remarks were â€Å"unacceptable, intolerable and contrary to the ideals of humanity and generosity that preside over the very existence of the festival. [†¦] The board of directors condemns these comments and declares Lars von Trier persona non grata at the Festival de Cannes, with effect immediately.†[55] Afterwards, von Trier held a news conference of his own in Danish. His first remark to the Danish journalists was: â€Å"If any of you journalists will beat me, so just do it. I will enjoy it.† He went on to say that â€Å"The Holocaust is the worst crime that ever happened. I have nothing against Jews. I have a Jewish name, and all my children have Jewish names.† He admitted that his remarks about the Nazis had been misguided, saying â€Å"It was really stupidly done and it was in the wrong forum. At the press conference with Danish journalists, there were no problems, but I do not think the international journalists understand my Danish humor.† But he also said he was proud to have been kicked out of the Cannes festival: â€Å"I am proud to have been declared ‘persona non grata’. It is perhaps the first time in cinematic history, it has happened. †¦ I think one reason is that French people treated the Jews badly during World War II. Therefore, it is a sensitive topic for them. I respect the Cannes festival very highly, but I also understand that they are very angry at me right now.†[56][55] Speaking to other news outlets he said that his comments were â€Å"very sarcastic and very rude, but that’s very Danish.† He also added, â€Å"I don’t sympathize with Hitler for one second.†[57] In the October 2011 issue of GQ, von Trier is quoted in an interview saying he was not really sorry for the comments he made, only sorry he didn’t make it clear that he was joking. He added, â€Å"I can’t be sorry for what I said—it’s against my nature.†[58] On 5 October 2011, von Trier was interviewed by police in Denmark about his remarks at Cannes. Afterwards, he announced that he had ‘decided from this day forth to refrain from all public statements and interviews’.[59] Honours Von Trier was made a Knight of the Order of the Dannebrog on 14 January 1997.[60] Ten years later von Trier decided to hand back the prize, saying that the Danish royal family are just â€Å"simple people of bad quality†.[61]

Importance of art Essay

Why is art important? This is a question many parents ask themselves when they are enrolling their child in school. â€Å"Arts education does solve problems. Years of research show that it is closely linked to almost everything that we as a nation say we want for our children and demand from our schools: academic achievement, social and emotional development, civic engagement, and equitable opportunity† (Smith). It is a proven fact that children involved in art make higher grades than children that are not involved. Exposure to the arts provides many important advantages because it affects the growth and progress of children and benefits children in many learning environments. Art is important to children in their developmental years because they are able to express themselves. You should start teaching art as early as possible. It also improves their learning process. Art makes children look forward to learning. Schools that have art programs usually have higher attendance. That is because students get excited about that art class and want to go to school and participate instead of their parents making them go to school. If there was no art in school, there would be more children dropping out and getting themselves in trouble. In some Dallas schools, they had budget cuts and had to cut some subjects and art was among those things. Many people worked to get art put back in some of those schools. Those people know how important art is and did their best to get it back for the children. Now the children are getting about forty five minutes a week of an art class of some sort. If a child starts in kindergarten, they will learn how to be confident, how to concentrate and focus, and also how to interact with people. Some children are shy and by participating they will learn how to do all of those things. Russell Granet stated, â€Å"When I grew up, it was standard to have a music teacher and a visual arts teacher, and you almost always did a school musical†. People rarely think of arts education as survival skills. In this quotation, Jarboe is saying art gives you all kinds of skills used to be successful. About eighty-three percent of Americans believe that arts education helps teach children how to communicate. About seventy-nine percent of Americans â€Å"agree incorporating the arts into education is the first step in adding back what’s missing in public education today† (Ruppert 5). Another seventy-nine percent of Americans believe â€Å"it is important enough for them to get involved in the amount and quality of arts education† (Ruppert 5). About fifty-four percent of Americans rate the importance of art a ten on a scale from one to ten (Ruppert 5). Participating in art activities help children in understanding human experiences, adapting to and respecting others ways of thinking and ideas. Art class feels like a safe haven from the outside world, a place for them to really get in touch with themselves and healthily express their pain and frustration. It also provides structure for activities outside of school such as family activities. The families not only learn more about art but also learn how to get along with each other because some families do not and the only time that child is happy is when they are at school away from that family. For a young person’s growth and development, being educated in art is considered to be important. Art stimulates and develops a child’s imagination. Creating art projects is a way to stimulate a child’s imagination. For example, giving a child Legos and letting them build whatever they want. It also has a tremendous impact in teaching life skills. Art education teaches life skills such as learning to solve problems and make decisions. It also nurtures important values. Art improves cognitive abilities and provides individuals with the ability to enjoy the life encouraging desires of making art. Other benefits art offers are team-building skills, respecting different perspectives and being aware of diverse beliefs and backgrounds. In art classes, a student will have to learn how to work together asking for help, or even having to work on a drawing together. If a student does have to work with another person on a painting or drawing a student will have to listen to that person’s ideas and if both of them have different viewpoints on something, each will have to respect that person’s viewpoints and vise versa. The same goes for being aware of different cultures and traditions. The arts also add to the education of young children by helping them realize the extent of human experience, see the diverse ways humans express feelings and convey meaning, and improve delicate and complex forms of thinking. Some people may paint or draw when they are feeling down or hurt. Art also helps children how to concentrate and focus while they are doing different things such as studying or trying to memorize something word for word. With that being said it helps you to gain more knowledge when it comes to your school subjects because you are learning how to concentrate. Some people were not able to be in any art classes when they were in school so they learn about art when their child comes home and tells them about it. The child is so excited about a drawing they drew or a painting they painted and they want to show their parents. The parents see how happy and excited their child is and wants to continue to have their child in that specific art class because they see their cheerfulness. â€Å"Attendance is higher in schools with art programs† (Granet) and this is why. It is a proven fact that when an art of some sort is combined with a core subject students seem to learn it better than not having that art included in that lesson. For example if a student is in a Spanish class learning new words and the Spanish teacher adds a fun activity to help the students learn those specific words. For instance, if the students are learning how to say different types of clothing the teacher could have an activity where the students are participating in a fashion show and while one student is walking down the runway the students that are watching is writing down what they are wearing and that is a way for those students to learn and it makes it fun for them. In conclusion participating in arts education in your school years is extremely important because you learn valuable skills. A person learns skills used for everyday life such as having self-esteem, problem-solving skills, and teaches a person to be creative. Also most Americans believe art in school is important because it teaches a child how to communicate with another person and in today’s society if you don’t know how to talk to someone or talk in front of someone and not be nervous that person is going to have a hard time trying to get a job. Shame on Trump or Shame on You? There has been to this day, forty-five Presidents come into office. All of whom have signed several executive orders while being in office, but our newly President, President Trump has already taken a step no other President has taken so quickly after moving into the White House. On January 27, 2017, President Trump signed an executive order that is being known as the immigration ban. Putting an indefinite ban on immigration from seven different Muslim countries including; Iraq, Iran, Syria, Somalia, Sudan, Libya and Yemen. Not allowing any refugees to enter the United States for 120 days and no Syrian refugees until further notice. Some are praising President Trump for his actions, others are despising him for it, but he is the commander in chief so why not just keep your opinion to yourself? People often are getting paid to put their opinions all over the internet to persuade people to agree with their argument or simply just prove why they believe they are right. Some articles on the internet are more opinionated than others, others are more credible, some are more persuasive. There are many criterias for evaluating, say, an article online, such as the language the writer uses, the writers background, the background on the website the article has been posted on, choices of images within the article, title of article, time the article was posted, how much the writer considers both sides of the argument and if the online article has different links attached to support their claims is another way to become credible. All the criteria listed previously are ways Michael A. Cohen, a main contributor for the newspaper, The Boston Globe on national politics and foreign affairs (Cohen, 2017) makes it easy to interpret his highly opinionated but very truthful and credible article posted about his negative opinions and bias thoughts on President Trumps actions of his executive order. The first thing you evaluate when you glimpse at this article are the two things in bold and big; the title, Trumps immigration order Shame on you, Mr. President and picture, a large group of people chanting and yelling while holding up signs reading REFUGEES WELCOME and SHAME ON TRUMP. Both immediate signs indicate to the reader that the following article will be in almost every way against Trumps immigration ban. The title uses charged language, such as the words Shame on you, those words are not typical words an author uses in their title unless their feelings towards it is trying to be made very clear, and in this case, it is because this makes it known instantly that (Cohen) is upset with Trumps decisions. Cohen also distinctly chose a picture of protesting people who are against the ban to simply show that he is not alone and has many supporters when believing that the order is wrong and goes against every American way. Before you start evaluating the article itself, it is important to find out how credible the author is. Michael A. Cohen contributes to The Boston Globe newspaper but he is also an author of a book on pivotal moments in American History called American Maelstrom: The 1968 Election and the Politics of Division. He has been employed as a speechwriter at the US State Department, as well as a lecturer at Columbia Universitys School of International and Public Affairs (Cohen, 2017). Since he has previously been a lecturer at a University, he must have a degree of some sort in world affairs or anything belong to that category, also because of him being an author over a novel on American Affairs and moments in American History adds to his credibility. Therefore, Cohen must know what he is talking about when it comes to politics and national issues because of all the things he has been doing in that field all his professional career. On top of all of that, Cohen has 44.5 thousand followers o n twitter and over 81.2 thousand  tweets. He has a lot of followers so therefore meaning people listen to him and believe him in what he has to say on any kind of topic which also adds to his reputation. Michael A. Cohen is a contributor to the newspaper, The Boston Globe. The Boston Globe has been Boston, Massachusetts primary newspaper for over 100 years. The newspaper has had many different contributors for them, with most of them being experts in their fields and what they write about within the newspaper. They include all different varieties of articles from politics, to sports, to kitchen, etc. It is a larger newspaper so therefore they are aware their reputation is on the line because more people will be reading their articles which in tales that they only hire credible and trustworthy authors who make them look good in the publics eye. First off, when you read this article the first thing that strikes the reader is the word choice Cohen uses throughout the article. He uses very charged language such as fundamentally un-American, slap in the face, Shame on you, pointless and wrong (Cohen M. A., 2017), all negative references towards the immigration ban. He uses such strong language because of how strongly he feels towards Trumps decision to ban immigrants. He states many things about immigrants and how Syrian immigrants are probably the least likely to harm Americans, and the countries that include all of the refugees who have harmed Americans in terrorist attacks are not part of the ban because Trump has business relations with all of those countries but none with the seven countries he banned immigrants from, which is considered to be strange according to Cohen. Cohen calls it fundamentally un-American because it turns against all the American values and slaps the faces of millions who are familiar with the Americ an and immigrant experience. Later at the end of the article, Cohen expresses Trumps immigration order is pointless, counter-productive, and  wrong. Period. (Cohen M. A., 2017) More charged language from Cohen out of anger towards the order because of his past and family history that led him to be in America in the first place. Cohen adds an important story about his ancestors to the article to express the importance of immigrants and allowing people to make their way into this great country. He includes how his mother was born in Great Britain but came to America as a child because her parents were German Jews who escaped from Nazi Germany into the UK where they luckily were basically given a second chance by escaping Germany then eventually migrating to America unlike the rest of his grandmother and grandfathers siblings and family members at the time who were trying to migrate to a new place and had a very difficult time doing so (Cohen M. A., 2017) . He uses this personal story to appeal the readers emotions by trying to reach out to not only people who agree with him, but to people who may be uncertain on how to feel about the order. He explains how without immigration his life would not even be possible right now. His ancestors came to America, the land of the free, looking for a better life and they were able to find it and start a life, have a son (Cohen) and allow him to have a life he may not have been able to have somewhere where they started, but now that is not a guaranteed possibility anymore and it causes pain to those refugees who got that opportunity because other will not and may not. Furthermore, this article is a very biased source for more reasons than just its choice of words. The fact that Cohen does not even consider being a little bit neutral shows that it is a very biased source. Never once does Cohen mention a reasoning as to why he believes Trumps order may be okay or why other Americans may support the order. He makes very clear within his article, Shame on you, President Trump. And shame on any American who refuses to condemn this. (Cohen M. A., 2017). Instantly, he makes it clear that if you, for some reason support the immigration ban then shame on you because you must be just as un-American as Trump has been for setting the ban in the first place. He shows no empathy for those who support it because the article is completely one-sided towards being against the executive order which is a kind of article that preaches to the choir, whose message speaks to mostly people who already agree with them and whos not exactly trying to persuade anyone to think their way by being considerate to both sides, but just degrading the side against Cohens opinion in this case. To add to the previous points, to make his article more credible, Cohen adds links throughout the article to support his claims he is making. When Cohen is stating how not one Syrian refugee has committed a terrorist attack on the United States, and how you are more likely to be struck by lightning or shot by a toddler rather than a refugee, he adds a link of a chart that a European Media Director on Human rights and world conflict who has over 65.5 thousand followers on twitter, tweeted, showing the death causes of Americans annually, and it clearly showing that other Americans and unusual things are killing more Americans than any kind of immigrants coming into the United States. (Stroehlein, 2017) Also, another way Cohen does this is when he claims that the countries who have committed terrorists attacks on the U.S. but who were not banned are all in business with Trump, he adds a link to an article in the NY Daily News that shows and states each country who is a business partner of President Trumps but did in fact have a role in some sort of terrorist attack on the United States, yet still is not on the list of the immigration ban, (Sommerfeldt, 2017) which does not seem to add up the most according to Cohen. Lastly, Cohens article was released just two days after the executive order was announced to the public. Which can go either way, it could be good because the article is so relevant, time wise, to the order so therefore meaning they are not just getting things from his past and using it against him; all the news and facts are all recent and accurate about Trump. Or it could be looked at as, it has only been two days since the order and people, like Cohen, still are absorbing the ban and are just ranting things out of their emotions of anger because they (Cohen) are affected by it more than the next person so therefore wanting to do all they can to express it is wrong and how terrible of a person President Trump is for doing this, which indeed makes this a very biased source in that aspect. To put it all together, Michael A. Cohen uses many different criteria to use in his article that prove his article is very biased and one-sided but also full of information and credible facts that cannot be ignored just because he is very stern with the words he chooses to use throughout his article. He uses charged language, specific images and does not mention or show remorse for the other side of the story to get his point across that he believes what President Trump is doing is wrong but with Michaels credibility, when the article was posted and the different links he uses to back up everything he claims, you should believe that what he is stating is true even if he is not being considerate towards those who have different views as him. It may be too early for Trump to be doing all of this and maybe it is just in time. Everyone is going to have their own opinion on it, and it may not be the same as the person next to you, and that is okay as well. But just because something or so meone seems inconsiderate of all sides and is very biased does not automatically mean that the source is not credible or reliable, and this article posted in The Boston Globe by Michael A. When used as a means to promote learning in children, punishments will only instill fear and children will not be willing to learn. Natrajan, (2003), argues that a parent might try to set future goals with the child and this promotes the child to learn quickly. On the contrary, punishments instill fear in the children and they develop a low regard on any goal that might be set by the parent. Positive reinforcements can work well with children by giving them tangible items or praising child for a task well done or even a hug. The children will learn to improve their behavior since they like rewards and gifts. Advocates of punishments argue that, when children get used to being rewarded with tangible items in order to involve in positive behaviors. In such a situation rewards and gifts can become a problem when they are too expensive for the parent to provide. According to Natrajan, (2003), gifts and rewards can be ineffective in promoting learning in children since children can develop an attitude that they have to be given rewards in order to perform specific tasks. In addition, advocating for a rewarding culture in children does not instill a sense of responsibility in them and children learn to perform tasks only because they expect to be paid. Advocates of positive reinforcement also argued that parents have been worried that positive attention might lead to ruining their children. However, supporters of positive reinforcement have maintained that positive attention encourages the children to yearn doing good in order to get support of parents. Proponents of positive attention, argue that rewards or commending children can ruin them only when given while not due. Proponents of positive reinforcements suggest that it would work well when a parent notices her child wrong things, by commenting something negative about the behavior. According, to Natrajan, (2003), such a comment from a parent might act as a reward for the undesirable behavior and the child will change since the children have realized the parent is not happy with the behavior. Supporters of positive reinforce also advocate for a parent to wait and notice when the child does something right and takes the opportunity to explain the wrong behavior. Proponents of positive reinforcements argue that when commending the child the focus should be on the parents feeling rather than criticizing the child. For instance, a child who is fond of snatching toys form her sister should not only be punished but the sister should also be congratulated for sharing toys with the others. According to, (Coon, 2005), reprimanding informs the person the response was not right but it does give the person the direction of the right thing. In circumstances that pose immediate hazard to children, like a situation where a child reaches for something hot or a picking a toy that rolls in the middle of the road, mild reprimanding will be applicable to stop disaster. Reprimanding in such circumstances works best if it produces actions that are incompatible with the response the individual wants to suppress. For instance, when a child stretches his/her hand to reach a hot stove, its best to reprimand the child by slapping the outstretched hand so that it is withdrawn immediately. Advocates of punishments argue that reprimanding lowers the possibility that a response will be repeated. According to (Coon, 2005), for punishments to be effective they need to be given after the undesired response takes place. A punishment works effectively by reducing the frequency of occurrence of the undesirable behavior. According to (Coon, 2005), the effectiveness of punishments in bringing to an end the undesirable behavior depends on their timing, strength and regularity. Reprimanding work best when it takes place when undesirable behavior is being witnessed and immediately afterwards and when it is applied each time such a response occurs. Advocates of punishments suggest that severe reprimanding following a situation that could have resulted to danger is extremely effective in bringing to an end to a behavior. For example, when a 12 year old child gets a shock by putting his/her finger in a light socket that may be the last time the child ever tries such. In many situations reprimanding on temporarily only suppress the behavior and responses restrained by mild punishments more often than not resurface. Supporters of positive reinforcements, according to Perry, (1973), argue that reprimanding cannot eliminate such vices like lying in children. Rutter, (1987), maintains that reprimanding only motivates the children to be better at lying and use the refined lying skills to other situations in which lying may advance their interests. He further adds that when children become experts in lying there is no any height of punishments that will change their behavior. According to (Rutter, 1987), use of positive reinforcement is more effective in stimulating learning in children than use of caning. For example, offering a piece of candy for a child who scores high marks on a test promotes the child to do better in future tests. In addition, use of verbal praise, such as telling the child well done my child stimulates a child to improve the performance in future tests. Advocates of punishments argue that reprimanding is stronger and lasts for a long time as compared to positive reinforcement. According to (Coon, Mitterer, 2008), in case a parent has a particular task which they wish their children to perform, and after accomplishing the task badly they are reprimanded on the other hand when they do them well they are reinforced mildly and they will accomplish the task mediocre. According to (Perry, 1973), when a parent displays discontent with the child when the accomplishment is poor then, the children are likely to change the situation. Cameron (2006), argues that the society has used punishments rather than positive reinforcements to promote desirable behavior although the results have not always been positive. Teachers have been known to reprimand children who do not complete their homework with the hope that students will be able grow a sense of accountability for their work. My own view is that I support the use punishment when children engage in wrong behaviors. According to the Bible spare the rod and spoil the child suggests that children should be reprimanded in order to stop undesirable behavior. Considerable punishment need to be applied to bring about behavioral change. The timing and intensity of the punishments should be dependent upon specific stimulus expected from children. For example, if a parent finds a 12 year putting objects in power socket, the child should be reprimanded and informed of hazards of electricity. The choices of whether to use positive reinforcement or punishments depend on the parent or the caregiver.

Cultural Relativism as Applied to Female Genital Mutilation "I remember the blade. How it shone! There was a woman kneeling over me with the knife. I bit her; it was all I could do. Then three women came to hold me down. One of them sat on my chest. I bit her with all my might." These words reflect Banassiri Sylla’s account of her experience undergoing female circumcision, also known as female genital mutilation (FGM), at the young age of eight in the Ivory Coast. This disturbing description of her struggle makes it hard to understand why any culture could support such a practice. Yet, it is estimated that about 132 million women and girls in about thirty African countries have undergone the same, or at least similar, cultural procedure as Banassiri. According to the World Health Organization, about two million girls undergo female genital mutilation every year and the percentage of women circumcised is as high as ninety-eight percent in countries such as Djibouti . Despite its popularity in Africa, FGM is under scrutiny by members of the international human rights community. In 1993, female circumcision was deemed harmful by the international Human Rights Conference in Vienna . The World Health Organization, UNICEF, and the UN Population Fund have planned programs designed to â€Å"completely eliminate [female genital mutilation] within three generations† , on the basis that FGM is a human rights violation. This gives rise to the obvious question as to whether human rights activists and organizations should be sensitive to the cultural practices of the people of Africa. Upton Sinclairs The Jungle Essay -- essays research papers

Several years before and after the turn the turn of the twentieth century, America experienced a large influx of European immigration. These new citizens had come in search of the American dream of success, bolstered by promise of good fortune. Instead they found themselves beaten into failure by American industry. Upton Sinclair wanted to expose the cruelty and heartlessness endured by these ordinary workers. He chose to represent the industrial world through the meatpacking industry, where the rewards of progress were enjoyed only by the privileged, who exploited the powerless masses of workers. The Jungle is a novel and a work of investigative journalism; its primary purpose was to inform the general public about the dehumanization of American workers. However the novel was much more effective at exposing the unsanitary conditions of the meatpacking industry. The public’s concern about the meat supply was so great that Sinclair later commented, â€Å"I aimed at the public’s heart, and by accident I hit it in the stomach.† He played the journalist role well, actually spending seven months in Chicago where he studied the inner workings of the meatpacking industry. The experience allowed him to describe first-hand the sickening environment of the modern industrial factory. After Jurgis loses his factory job, he begins a frustrating search for new employment. Eventually he is forced into taking a job at the fertilizer plant, the worst place in the town. Sinclair makes it clear that the worker will, in fact, be working in sewage. The fertilizer works of Durham’s lay away from the rest of the plant. This this part of the yards came all the â€Å"tankage,† and the waste products of all sorts; here they dried out the bones—and in suffocating cellars where the day light bending over whirling machines and sewing bits of bone into all sorts of shapes, breathing their lungs of the fine dust, and doomed to die, every one of them, within a certain time. Here they made the blood into albumen, and made other foul-smelling things into thins still more foul-smelling. In the corridors and caverns where it was done, you might lose yourself as in the great caves of Kentucky. (p. 152) The thought of working in the waste of Packingtown disgusts Jurgis so much that he wishes he doesn’t get hired. Jurgis is a typical immigrant worker, and he realizes that this job is his â€Å"only hope.† T... ...r’s intended result was to show that the forces of industry capitalists would drive the working class to Socialism. Jack London, famous Socialist, commented, â€Å"What ‘Uncle Tom’s Cabin’ did for the black slaves ‘The Jungle’ has a large chance to do for the white slaves of today.† By demonizing American industry he hoped to change the world. There are only a dozen or so pages concerned with the horrid details of meat production, but it was these informal references to the food they were buying and eating that angered the people and created public demand for reform. It succeeded on both fronts, leading President Roosevelt to sign the Pure Food and Drug Act as a result. Apush Taxation Without Representation Dbq

The motivations of American Revolutionary movement, at its peak from 1765 to 1780, are a much disputed subject between historians like Bernard Bailyn and Esmond Wright. One of the questionable motivations is the demand for no taxation without representation from the colonies at the time. It becomes clear through the documents of the Virginia House of Burgesses and Stamp Act Congress as well as letters from Thomas Jefferson that no taxation without representation was the primary motivation and unifier of the American colonies between 1765 and 1780.In the mid-1700’s, due to the high debt created by the British after the French and Indian War, parliament created a series of new taxes used on only the American colonies to gain revenue. One of the most unpopular taxes, called the Stamp Act, required a stamp to be put on all legal documents for a certain fee. This upset many people in the colonies including the Virginia House of Burgesses, which was the legislature in Williamsburg, Virginia, at the time.The committee there created a resolution to ask the same rights as Britons, who had representatives in Parliament to defend themselves against taxation without representation (Document A). Since the British Parliament did not listen to the colonial legislatures individually, some of the colonies joined forces to create Stamp Act Congress. This grouping was the first formal and organized unification of the American Colonies at the time and would snowball into the first and second Continental Congress which would take place ten years later.Stamp Act Congress (Document B) addressed issues and their possible solutions relating to the House of Commons in Great Britain, the Parliament. With the issue the Virginia House of Burgesses addressed, the Stamp Act Congress created the resolution of having a representative democracy styled legislature to discuss matters of taxation. These ideas were on par with that of the Considerations on the Propriety of Imposing Taxes in the British Colonies by Daniel Dulany which stated â€Å"A right to impose an internal tax on the colonies, without their consent for the single use of revenue, is denied. (Document C) â€Å"No taxation without representation! † was the slogan of many patriot groups like the Sons of Liberty in the mostly unified colonies of the 1770s. These patriots like Joseph Warren, who played a leading role in the patriot organizations in Boston and was a militia general at Bunker Hill, said that taxation without representation â€Å"could not be supported by reason and argument† and that â€Å"upon fair examination, appeared to be unjust and unconstitutional. † (D) Beginning with the Stamp Act of 1764, the colonists found themselves with an unfair laws and government on their hands.With this issue at hand, new legislatures were formed in the American Colonies like The Stamp Act Congress (B), First, and Second Continental Congress. These legislatures strived for a represent ative democracy, one better than the one they were deprived of in House of Commons in Great Britain. By the 1770s, the ideals of rights of men, as those mentioned in the Virginia House of Burgesses (A) and Joseph Warren (D), spread throughout the colonies. It was the demand of no taxation without representation that unified the colonies and drove them toward a representative democracy which every man has his say.

Separation of Powers – Importance of Judicial Independence

The Jamaican Constitution (hereinafter â€Å"the Constitution†) came into effect with the Jamaica Independence Act of 1962. The Act was tabled to ‘make provision for and in connection with, the attainment by Jamaica of fully responsible status within the Commonwealth. ’ This document formed the framework for Jamaica’s political independence and created the premise on which this fledgling nation could carve out its own legal system based on its own moral, cultural and political experience.The Constitution though largely reflective of the previous colonial relationship, has within it an innate balance of power between the arms of government that is theoretically and fundamentally positioned to support the country’s self-governance. This balance is so designed, to facilitate the critical functions of government while ensuring that no single body so fully controls the reins of power that it’s will can be imposed without the acquiescence of the oth er parties, and the greater society.This balance is grounded in the principle of the Separation of Powers, implied by the Constitution. With the complex interplay of relationships, and the significance of power within the Executive, the Legislature and the Judiciary, the latter emerges as the keepers of the gate in maintaining this equilibrium through its function as the arbiters of justice. The Doctrine of the Separation of Powers was first proposed by the Greek philosopher Aristotle (384-322BC), and made popular in the 17th century by French writer Charles Louis de Montesquieu.Montesquieu argued that for an independent judiciary to exist, the three arms of government must have separate and independent powers within their areas of responsibility, otherwise we run the risk of there being no liberty, arbitrary control, violence and oppression. This principle may be applied to varying degrees in any legal system and may or may not be a legal restriction; however it is a very effective tool used to protect the rights and liberties of citizens from tyranny.The Constitution by virtue of Section 34, establishes Parliament (the Legislature) as the first arm of government and comprises the Queen (represented by the Governor General) and two Houses: the Senate and the House of Representatives. Under Sections 48 –50, it is given power to make laws for the peace, order and good governance of Jamaica, decide special rights, immunities and powers of the Senate, the House of Representatives and its members; and the conditional power to alter the Constitution.By virtue of Section 68, the Governor General is given Executive power to be used on the Queen’s behalf either directly or through officers under him. Section 69 establishes the Cabinet as the main body to direct policy. The Cabinet, consisting of the Prime Minister and other Ministers chosen by him, manages the general administrative functions of the Government and is accountable to Parliament. The Govern or General together with the Cabinet comprises the Executive arm of Government, the second arm of government.The Judiciary is the third arm of Government. It comprises judges and magistrates from the network of courts that form the legal system. Sections 97 and 103 of the Constitution establish the Supreme Court and the Court of Appeal, respectively. The Chief Justice and the President of the Court of Appeal are appointed by the Governor General on the advice of the Prime Minister in consultation with the Leader of the Opposition.The other Puisne Judges are appointed by the Governor General on the advice the Judicial Services Commission. It is important to note that there is some degree of inter-connectivity between the Executive and the Legislature, as members of the Cabinet are also members of Parliament. The sharing of personnel between these two bodies compromises the strict application of the doctrine of the separation of powers. It is therefore imperative that the Judiciary ex ecutes its functions in an independent manner.The Constitution supports the assertion that the Judiciary has not only the right, but the responsibility to review the affairs and policies of the Executive and Legislature to ensure that their powers are being exercised within the limits of the Constitution. In exercising this duty, a court can declare a law unconstitutional and therefore null and void as in the case of Adrian Nation, Kereen Wright v DPP and the Attorney General of Jamaica. In Moses Hinds v. The Queen it was underscored that the fair and effective dministration of justice constitutionally rests only within the powers of the Judiciary and in Independent Jamaica Council for Human Rights Ltd. and Others v. Marshall-Burnett and the Attorney General of Jamaica, the Privy Council overruled the judgment of the Jamaican Appellate Court in finding that the three Bills attempting to remove the Privy Council as the final appellate court were unconstitutional. This decision was ba sed on their previous ruling in Hinds.As demonstrated in other Commonwealth jurisdictions, the Judiciary may indirectly place pressure on the Legislature to ensure that laws are drafted intra vires, in the first instance. In attempting to avoid ultra vires rulings, the Legislative often times â€Å"†¦tests its own legislation in the courts. This occurred in Suratt et al v Attorney General of Trinidad and Tobago wherein the Trinidad and Tobago Government defended an action on the grounds that a Bill seeking to promote equality was unconstitutional by virtue of its being discriminatory. This challenge to legislation is another example of the check and balance of the Separation of Powers. The Judiciary is thus required to rule on complex issues that have direct implications for the members and institutions within society, including the other arms of government; with impartiality and in accordance with the Rule of Law. The rule of law as proposed by A. V. Dicey asserts that no man should be punished except for conduct in clear breach of the law. This assertion supports the fact that the legal system rests on the objectivity of the Judiciary.Where we are governed under a system which rests upon the impartial application of laws, and under which citizens’ rights and obligations are regulated by those laws, there must be an established and accepted system for making law. The law must be publicly known. Interference with rights and obligations must be justified within the law as the perception of rights, freedoms and equality in society is influenced by the quality of Judicial rulings. In the spirit of Judicial Independence, the Judiciary must be impartial and may not be influenced by any source except the law.Within the Constitution, security of tenure and security of salary are entrenched provisions designed to insulate the Judiciary from pressure intended to influence their rulings. Judicial Impartiality is defined as ‘the freedom of each individ ual judge to reach a decision within the law without undue interference or pressure from government, other judges, the media or any other source. ’ While attempts to directly interfere with the fair and effective administration of justice may be limited, it can be argued that several factors undoubtedly affect the court’s ability to properly execute its role.Particularly within the Jamaican context, financial constraints arising out of cost-cutting measures of Parliament and limitations in Ministerial budgets have severely affected the resources and physical infrastructure required for the efficient operations of the machinery of the Judiciary. In recent times, influential voices in the Jamaican legal fraternity have highlighted the need to address the issue of limited resources. The Director of Public Prosecutions, Paula Llewellyn have stated that â€Å"the country is struggling with a low capacity court situation and that is affecting how the wheels of justice turnà ¢â‚¬ ¦.. ou should have been building more courtrooms and making sure you have more personnel, court reporters, prosecutors, resident magistrates†¦. and that was not being done. † The Judiciary also provides guidance to the citizens and other branches of government on matters relating to the Constitution, through statutory interpretation and application of general principles of law while settling disputes brought before them. Their ability to be fair and impartial is particularly challenged when called upon to interpret and rule on legal documents that are poorly drafted or ambiguous.Although the law lends itself to flexibility and expediency, the question arises in some instances whether the ruling accurately represents the will of the Legislative as some appeals have been advanced on the grounds of statutory misinterpretation as in the case of R v East Berkshire Help Authority ex parte Walsh. Judges may find themselves inadvertently assuming the role of creating legal r ights when required to make plain issues not explicitly addressed by legislation.It has been debated that these so-called ‘created laws’ are not in fact created but are legal principles which lay dormant until judges’ interpretations unearth them. This was the position taken by Brett, M. R, in Munster v Lamb. However, the perception is that this ‘power’ does indeed exist as, in plural societies right and wrong are just as plural and judges must ensure that conclusions sufficiently represent a   fair carriage of justice. If the Judiciary were acting solely as the mouth piece of the Legislature and the Executive with no independent thought or justice-driven compass, this arm of government would hardly be relevant.In Earl Pratt and Ivan Morgan v The Attorney General and The Superintendent of Prisons, Saint Catherine, the Privy Council interpreted inhumane treatment under section 17(1) of the Constitution of Jamaica to include delay between conviction and the carrying out of the death penalty though the constitution was silent on this matter. This interpretation created a legal right which had the effect of automatically commuting death penalty convictions for convicts on death row in excess of five years to life imprisonment.The Judiciary also exercises its constitutional mandate through a process of Judicial Review which is the means by which â€Å"Government departments, local authorities or others with law-making and administrative powers are confined by the courts within powers granted by the [Constitution]. .   Although Jamaica does not have a specific Judicial Review Act, provisions for judicial and constitutional claims fall under Administrative Law Claims in section 56 of the Supreme Court of Civil Procedure Rules, 2002. Judicial Review is an important tool of the Judicial Branch.It is considered a grave and ominous â€Å"responsibility which the courts must not shirk from or attempt to shift to Parliament† â⠂¬Å"as this responsibility in and of itself is a system of checks and balances thus seen as the: last bulwark of citizenry. †   The grounds for Judicial Review includes error of law, failure to observe the principles of equity, abdication of functions, improper delegation of authority, and unreasonableness of a decision. All are supporting grounds for the argument that the maintenance of fair justice is eally what is at the heart of the function of the Judiciary. â€Å"Remedies for judicial review include: Certiorari, for quashing unlawful acts, Prohibition, for prohibiting unlawful acts and Mandarmus, (now mandatory order), for requiring performance of a public duty, including a duty to make a decision or determination, or to hear and determine any case†6. The fair administration of justice by Jamaica’s courts is influenced by the fact that its final court of appeal rests outside its jurisdiction.According to the principle of stare decisis or Judicial Preceden ce, courts are bound follow the ruling of higher or equal courts. With the Privy Counsel being retained by the Constitution as Jamaica’s final appellate court, the discussion arises whether the rulings of that external body are sympathetic to the Caribbean experience and thus a fair and effective administration of Justice. According to Sharma JA of the Trinidadian Court of Appeal in Boodram v.AG and Another, â€Å"even after our independence, our courts have continued to develop our law very much in accordance with English jurisprudence. The inherent danger and pitfall in this approach is that, since Independence our society has developed differently from the English and now requires a robust examination in order to render our Constitution and common law meaningful. † The Jamaican Constitution was so designed to support and to be supported by the Doctrine of Separation of Powers between the Legislative, the Executive and the Judiciary.Though not free of limitations, th e Doctrine effectively balances power among the three bodies, ensuring that encroachments that are not in the interest of justice are held somewhat in check. The sharing of personnel between the Executive and the Legislative bodies in the Jamaican Parliament, however, can lead to cynicism and has the potential for corruption. It is therefore imperative that the Judiciary be allowed to function independently and be protected from interference from those who would seek to influence its decisions.Despite the intent of the Constitution’s authors, the justice system can only be determined to be fair or faulty based on human factors, the judges. The Constitution is a function as well as a reflection of the society it serves and as such our moral, cultural and economic experience will determine how our justice system evolves and whether the tenets on which it is founded are sufficiently strong and rooted to support Jamaica’s political and legal independence.
